While I was circling the grounds of the Oritani Field Club yesterday in search of phantom apartments, I came across this undated notice on the periphery of the OFC's western edge that appears to have either been ignored or is a bit too late.

The tree was a damn invasive Ailanthus. There is no controversy. What kind of moron tree-hugs that kind of giant weed?

The type of tree is irrelevant. His issue appears to be that he doesn't want his property line moved unilaterally. Assuming that his opponent is Hekemian, would his 50-year-old fence supersede anything that might have been transferred by the Oritani Field Club, whose ownership of the property exceeds 90 years?

Hekemian wouldn't have purchased the property without having it surveyed. The survey should have located anything growing along the property line such as the tree in question. If the tree / trees are or were on Club property, so be it. If the adjacent property owner disagrees with the survey, he can hire his own surveyor to survey that property line.
The type of tree is irrelevant to the situation . If they were wrongly removed, then the property owners either negotiate a settlement or go to court.

Fences everywhere are set back a few inches from property lines in order to dig footings. Even HE acknowledges that it's "a few inches". I'm not a lawyer, but I think it's too small a distance for the adverse possession laws to come into effect.

I spoke with one of the involved parties yesterday and I'm told that everything has been settled.
